PUBLIC OFFER AGREEMENT

1. General Provisions

1.1. This Agreement is concluded by the Buyer through full and unconditional acceptance (acceptance) of the terms of this Agreement.

1.2. The Seller is the service and website https://gerchak.com.ua/ (hereinafter referred to as the “Website” or the “Seller”), which sells goods through the Website.

1.3. The Buyer is any individual who places an order for goods on the website https://gerchak.com.ua/ (hereinafter referred to as the “Website”) or by another method determined by the Seller.

2. Subject of the Agreement

2.1. The Seller undertakes to transfer ownership of food products and other goods presented on the Website to the Buyer, and the Buyer undertakes to accept and pay for such goods under the terms of this Agreement.

2.2. The assortment, descriptions, prices, and main characteristics of the goods are published on the Website and constitute an integral part of this Agreement.

3. Order Placement

3.1. The Buyer places an order independently through the Website or by another method agreed upon with the Seller.

3.2. When placing an order, the Buyer undertakes to provide accurate information, including:
full name, contact phone number, email address, and delivery address.

3.3. The Seller shall not be liable for consequences arising from the Buyer providing inaccurate or incomplete information.

4. Price and Payment Procedure

4.1. Prices for the goods are indicated on the Website and are stated in Ukrainian hryvnias (UAH).

4.2. Payment for the order is made on a full prepayment basis (for retail customers), unless otherwise agreed by the parties.

4.3. Payment methods: cashless (non-cash) payment.

5. Delivery of Goods

5.1. Delivery of the goods is carried out throughout the territory of Ukraine by the methods indicated on the Website.

5.2. The cost and delivery time depend on the selected delivery method and carrier.

5.3. The Seller’s obligation is deemed fulfilled at the moment the goods are handed over to the carrier.

6. Exchange and Return of Goods

6.1. In accordance with the legislation of Ukraine, food products of proper quality are not subject to exchange or return.

6.2. Exchange or return is possible only in the following cases:

  • manufacturing defect;

  • damage to the goods during transportation;

  • incorrect order fulfillment.

6.3. The Buyer must notify the Seller of any issue within 24 hours from the moment of receipt of the goods.

7. Rights and Obligations of the Parties

7.1. The Seller undertakes to:

  • transfer goods of proper quality to the Buyer;

  • provide accurate information about the goods;

  • comply with the terms of this Agreement.

7.2. The Buyer undertakes to:

  • provide correct contact details;

  • pay for the goods in a timely manner;

  • accept the goods in accordance with the order conditions.

8. Liability of the Parties

8.1. The parties shall be liable in accordance with the current legislation of Ukraine.

8.2. The Seller shall not be liable for delivery delays caused by the carrier.

9. Personal Data Protection

9.1. By providing personal data, the Buyer agrees to their processing in accordance with the Privacy Policy published on the Website at […].

10. Other Terms

10.1. This Agreement is valid indefinitely from the moment of its publication on the Website.

10.2. The Seller has the right to amend this Agreement without prior notice to the Buyer.
